The Ombudsman found that the Council had been aware of the issues with the guttering for many years and that these issues were the main cause of the damp issues in the property. The Ombudsman said that this caused inconvenience to Mr A and had affected his health. The Ombudsman decided to settle the complaint without an investigation.

The Ombudsman sought and gained the Council’s agreement to, within 2 weeks: • Apologise to Mr A for the delays in resolving the damp and guttering issues in his property.

• Arrange a priority appointment with Mr A to carry out the necessary work to fix the guttering issues.

The Ombudsman also sought and gained the Council’s agreement to, within 1 month: • Offer Mr A £500 redress for the inconvenience caused.
