We will not investigate Ms X’s complaint about the Council delaying in repairing highway defects outside her property. It was reasonable for Ms X to take any claim of highway maintenance failure to the Magistrates’ court. There is not enough evidence of Council fault to warrant us investigating and an investigation would not lead to a different outcome. It would be reasonable for Ms X to make any claim of property damage to the Council’s insurers and, if necessary, to the courts.
