The Ombudsman's final decision

Summary: We will not investigate this complaint about the Authority not dealing with Miss X’s request to resolve her issues, relating to a speed camera. The matter she complained about is not an administrative function of this Authority.

The complaint

Miss X complained because the Council would not accept it was responsible for road markings alongside a speed camera. It also said it was not responsible for the maintenance of this camera.

The Ombudsman’s role and powers

The Local Government Act 1974 sets out our powers but also imposes restrictions on what we can investigate.

We cannot investigate complaints about actions which are not the administrative function of a council. (Local Government Act 1974, section 26(1) as amended).

How I considered this complaint

I considered information provided by the complainant and I considered the Ombudsman’s Assessment Code.

My assessment

Miss X complained about issues relating to a speed camera, including faulty road markings and a fault with the camera. The Authority said it was not responsible for these matters.

Final decision

We will not investigate Miss X’s complaint because it does not relate to an administrative function of this Authority.
