The Ombudsman’s role and powers
The Local Government Act 1974 sets out our powers but also imposes restrictions on what we can investigate.
We cannot investigate complaints about actions which are not the administrative function of a council. (Local Government Act 1974, section 26(1) as amended).
How I considered this complaint
I considered information provided by Miss X.
I considered the Ombudsman’s Assessment Code.
Final decision
We will not investigate Miss X’s complaint because the Council confirms it does not own or maintain any speed cameras. Therefore this complaint does not concern an administrative function of the Council.
