Introduce legislative changes to allow flexible compensation order value adjustments for victims.

Recommendation
The Government should introduce changes to compensation order legislation to allow for flexibility in altering the order value if a criminal is later found to have assets of greater value which can be used to compensate victims of their crimes. This would bring practice into line with that already in place for the amendment of confiscation orders to allow for increased asset recovery.

The Government agrees that tackling fraud requires a unified and co-ordinated response from government, law enforcement and the private sector to better protect the public and businesses from fraud, reduce the impact of fraud on victims, and increase the disruption and prosecution of fraudsters. The Home Office continues to drive forward this collaboration by convening public and private sector partners through the Joint Fraud Taskforce, which last met on 21 November 2022. The Government will shortly publish a new strategy which will detail how we will: stop fraud attempts so that people don’t lose money; empower potential victims to recognise and avoid fraud; and prosecute far more fraudsters. We will work with industry to remove the vulnerabilities that fraudsters exploit; with intelligence agencies to shut down fraudulent infrastructure; with law enforcement to identify and bring the most harmful offenders to justice; and with all partners to ensure that the public have the advice and support they need.
