Full decision

The Ombudsman's final decision

Summary: We cannot investigate this complaint about a transport company’s refusal to award X with a concessionary travel pass. The transport company is not a body who’s actions we can investigate. Nor can we consider a complaint about the Authority’s role, because the transport company was not performing an administrative function of the Authority.

The complaint

X complained about the decision a transport company took, to refuse an application for a concessionary travel pass. They said its decision was contrary to relevant legislation. X said because the company was providing services on behalf of the Authority, it was equally liable for this decision.

The Ombudsman’s role and powers

We cannot investigate complaints about actions which are not the administrative function of an organisation. (Local Government Act 1974, section 26(1) as amended).

How I considered this complaint

I considered information provided by the complainant and I considered the Ombudsman’s Assessment Code.

Final decision

We cannot investigate X’s complaint because the transport company was not performing an administrative function of the Authority.
