The Council was at fault in delaying in issuing an Education, Health and Care Plan for child Y. It was also at fault for failing to arrange suitable alternative educational provision for Y. The Council’s handling of Mr X’s complaint was poor. The Council’s faults caused Y lost educational provision, and caused Mr X uncertainty, frustration, put him to time and trouble and delayed his appeal rights. The Council agreed to apologise and make payments to Mr X to remedy the injustice caused by its faults. It has also agreed recommendations to improve its services.
