The Council was not at fault for not securing a suitable alternative education for Miss X’s child, Y, before June 2025. The Council was at fault for delaying issuing Y’s Education Health and Care Plan for around 10 weeks after a Tribunal order and for failing to secure the provision in Y’s Plan between April 2025 and July 2025. This caused Miss X frustration and uncertainty, and meant Y did not receive the SEN provision in the Plan for one term. The Council has agreed to apologise and make a payment to Miss X.
