Mrs X complained about the Council’s failure to provide her daughter (Y) with suitable education and to ensure she received provision included in her Education Health and Care Plan. We found fault with the Council’s failure to decide whether it owed the alternative provision duty to Y and its failure to monitor any educational arrangements made by Y’s school. The Council’s fault caused injustice to Y and Mrs X. The Council has agreed to apologise and make payments offered in its stage two complaint response.
