The Council was at fault for its failure to consider if light disturbance into Mr X’s home was a statutory nuisance. Mr X said the light led to significant sleep disturbance. Poor complaint handling by the Council also caused him frustration. The Council has agreed to apologise to Mr X and make a payment to remedy the injustice to him. The Council should also arrange to investigate if the light disturbance is a statutory nuisance.
