The Ombudsman's final decision

Summary: We cannot investigate this complaint about The Council’s response to Mr X’s reports of threats. This is because the complaint is about the Council’s management of social housing, as a landlord, and therefore it is outside our jurisdiction.

The complaint

Mr X said he was unhappy with the service he was provided by officers involved in his case, including the fact they did not respond to a report of threats. He said this affected his health.

The Ombudsman’s role and powers

The Local Government Act 1974 sets out our powers but also imposes restrictions on what we can investigate.

We cannot investigate complaints about the provision or management of social housing by a council acting as a registered social housing provider. (Local Government Act 1974, paragraph 5A schedule 5, as amended)

Final decision

We will not investigate Mr X’s complaint because the Council’s actions relate to its response in managing social housing as a register provider and is outside of our jurisdiction.
