The Ombudsman's final decision

Summary: We will not investigate this complaint about gates on a right of way as the matter has been resolved.

The complaint

Miss X complains the Council rescinded permission for her to install gates on a public right of way. Miss X says this caused stress and difficulties with her livelihood.

The Ombudsman’s role and powers

It is our decision whether to start, and when to end an investigation into something the law allows us to investigate. (Local Government Act 1974, sections 24A(6) and 34B(8), as amended)

How I considered this complaint

I considered information provided by the complainant and the Council.

I considered the Ombudsman’s Assessment Code.

My assessment

Miss X has contacted me to withdraw the complaint as she says she has resolved the situation with the Council and no longer wishes to proceed. As such, we will not investigate.

Final decision

We will not investigate Miss X’s complaint because she has withdrawn it.
