Mrs X complained the Council did not meet the legal timescale to issue her son Y’s Education, Health and Care Plan, did not secure the special educational provision in the plan, and did not secure suitable alternative educational provision. We find the Council at fault for not meeting the legal timescale, and not securing all his special educational provision. This caused distress and missed special educational provision. The Council has agreed to apologise and make a symbolic payment to remedy the injustice.
