The Ombudsman's final decision
Summary: We will use our discretion not to investigate this complaint about temporary accommodation because the complainant’s circumstances have changed.
The complaint
The complainant, Ms X, complained about her temporary accommodation.
The Ombudsman’s role and powers
It is our decision whether to start, and when to end an investigation into something the law allows us to investigate. (Local Government Act 1974, sections 24A(6) and 34B(8), as amended)
How I considered this complaint
I considered information provided by Ms X and the Council. This includes the complaint correspondence and updates from the Council and Ms X. I also considered our Assessment Code.
My assessment
Ms X complained about the condition of her temporary accommodation and said it was too small.
Since complaining to us Ms X has left the property and is staying with family. She asked the Council to discharge its homelessness duty to her.
Final decision
We will not investigate this complaint because Ms X’s circumstances have changed and she said she did not want to continue with the complaint.
