The Ombudsman's final decision

Summary: We cannot investigate this complaint about the Council’s actions concerning Mr X’s children. These are not separable from court action.

The complaint

Mr X said he was aware we cannot change the outcome of a court order, and he intends to take further court action. But he said he wanted us to help in ensuring the Council was investigated fully.

The Ombudsman’s role and powers

We cannot investigate a complaint if someone has started court action about the matter. (Local Government Act 1974, section 26(6)(c), as amended)

How I considered this complaint

I considered information provided by the complainant.

I considered the Ombudsman’s Assessment Code.

My assessment

The actions of the Council about Mr X’s children directly relate to the court orders to which Mr X refers.

Final decision

We cannot investigate Ms X’s complaint because the matters he complains of are not separable from those subject to court proceedings.
