PUWER 4(1) - Robinson Brothers Ltd have failed to ensure the health and safety of their employees in that they have failed to ensure that work equipment, specifically Bulk Methanol Storage Tank T122 (manufacturer’s job number 620186) and Tank T123 are so constructed as to be suitable for the purpose for which they are intended, in that they have not been bolted down so as to prevent movement of the tanks. PUWER 6(2) - Robinson Brothers Ltd have failed to ensure the health and safety of their employees in that they have failed to ensure that structural steelwork supporting safety critical pipework, vessels and other equipment is in itself included on the register of safety critical equipment, and so inspected at suitable intervals to ensure that any deterioration of said steelwork can be detected and remedied in good time, so as to avoid a significant loss of containment.

PUWER 4(1) - Robinson Brothers Ltd have failed to ensure the health and safety of their employees in that they have failed to ensure that work equipment, specifically Bulk Methanol Storage Tank T122 (manufacturer’s job number 620186) and Tank T123 are so constructed as to be suitable for the purpose for which they are intended, in that they have not been bolted down so as to prevent movement of the tanks. PUWER 6(2) - Robinson Brothers Ltd have failed to ensure the health and safety of their employees in that they have failed to ensure that structural steelwork supporting safety critical pipework, vessels and other equipment is in itself included on the register of safety critical equipment, and so inspected at suitable intervals to ensure that any deterioration of said steelwork can be detected and remedied in good time, so as to avoid a significant loss of containment.

By failing to carry out an assessment you are putting any workers under your control at risk of exposure to asbestos which can cause asbestosis or mesothelioma. As a dutyholder with maintenance and repair responsibilities, you have failed to ensure that: a) A written plan, namely an Asbestos Management Plan, is prepared identifying the parts of your premises where you have ascertained there is a risk that asbestos is or is liable to be present and b) the measures that are to be taken for managing that risk are specified in the plan.

Improvement Notice 1 - You have failed to ensure that exposure of your employees working in the sieving (pastry) room to substances hazardous to health, namely Flour dust, is either prevented or where this is not reasonably practicable, adequately controlled. Improvement Notice 2 - You have failed to ensure that employees who are, or are liable to be, exposed to substances hazardous to health, namely flour dust, are under suitable health surveillance.

Improvement Notice 1 - You have failed to ensure that exposure of your employees working in the sieving (pastry) room to substances hazardous to health, namely Flour dust, is either prevented or where this is not reasonably practicable, adequately controlled. IN - 315565108 - You have failed to ensure, so far as is reasonably practicable, the health, safety and welfare at work of all your employees and you have failed to conduct your undertaking in such a way as to ensure, so far as is reasonably practicable, that persons not in your employment who may be affected thereby are not thereby exposed to risks to their health or safety in that you have failed to ensure any person (whether or not his employee) who carries out work in connection with the employer’s duties under these Regulations has suitable and sufficient information, instruction and training in that your appointed person has not received suitable training to carry out their duties in relation to control of risks from legionella.
