This dilemma has been addressed by Lothian and Borders Police and Strathclyde Police may wish to consider how it is dealt with in that Force.

The guidance therefore would not seem to be clear as I read it to be, because I have two interpretations of it from senior police officers and if it is ambiguous as Superintendent Docherty himself appears to think on the basis of his evidence the draft should perhaps be reconsidered.

It is to be hoped that Strathclyde Police and other forces will keep this situation under review because plainly on the evidence before me the higher the light is mounted the more chance there is of it being visible in this sort of situation.

They have to be able to switch quickly from such covert operation to being readily visible as a police car and that is a consideration which requires further attention by not just Strathclyde Police but all forces given that in the particular circumstances of this accident (which are it is recognised a most unfortunate set of occurrences) negated the effectiveness of the existing systems fitted.

3. TU94 not being readily identifiable as a police vehicle answering an emergency call due to the ineffectiveness of its emergency light systems, this being related to the sightline difficulties; this problem of identification of unmarked vehicles by other road users should continue to be studied and held under review by Strathclyde Police and other forces using such vehicles with a view to fitting forward - facing blue lights at a higher level than, or in addition to, those in the same plane as the headlights;
