The lack of an effective system of supervision, resulting in his being able to operate in this way, was clearly a defect in the system of working which contributed to the accident. It was also a significant defect in that in construction work it may frequently be tempting to make the job easier by cutting corners and taking risks and given the potential consequences, it is of vital importance that there should be an effective system in place to ensure that this does not happen.
Under section 28 of the 2016 Act, each recipient of a recommendation must respond within 8 weeks.
