Recommendation
However, public authorities are in limbo until the Government publishes final guidance on the subsidy control regime. The UK Government needs to end this uncertainty by following the Scottish Government, which published guidance in September 2022, and publishing final guidance without delay. Only then will public authorities be in a position to make awarding decisions on subsidies with confidence and to prepare bids for funding from the UK Shared Prosperity Fund.

The CMA has three strategic aims for its work in digital markets; to protect people from harms and enable them to select the products and services best suited to their needs; for businesses to have fair access to markets as customers, suppliers and competitors; and for dynamic competition in digital markets to create an attractive ecosystem for investment and innovation. While awaiting the powers afforded by the new pro-competition regime for digital markets, the CMA will continue to investigate instances where consumer harm or abuses of market dominance warrant intervention, and to make best use of existing tools. The CMA has a number of open Competition Act 1998 (CA98) cases relating to digital firms, a new programme of consumer enforcement work focused on tackling potentially harmful online selling practices and a Market Investigation into cloud gaming services and mobile browsers. The CMA will continue to collaborate with international stakeholders, both bilaterally and through multilateral fora, to share knowledge and intelligence where appropriate and where this works towards promoting competition and preventing harms in digital markets.
