Conclusion
The Department for Education and the Student Loans Company need to both jointly and separately establish who is legally responsible for what. In particular, they must establish whether the student loan application form makes students sufficiently aware of the unusual terms of the loan, which allow the government to change terms and conditions retrospectively.
