The policies of the trust relating to the Mental Capacity Act and the DoLS should be re-visited in light of the above comments and the new Code of Practice. In particular, clearer guidance regarding overall responsibility for implementation, the MCA provisions regarding best interests in the context of restraint, the determination of deprivation of liberty, the eligibility requirement, and the provision of IMCAs is appropriate.
