The complainant has requested minutes of the Department for Transport’s board meetings for the last 18 months. The DfT refused the request under section 35 – formulation and development of government policy. During the course of the Commissioner’s investigation the DfT release some information but also applied section 36 – prejudice to the conduct of public affairs to some of the information it continued to withhold. A small amount of information was also withheld under section 40 on the basis that it was the personal data of the attendees. The complainant has not contested the application of section 40.  The Commissioner’s decision is that the only a limited amount of information can be withheld under section 35. A larger amount of information can be withheld under section 36. The information that can be withheld has been identified in an annex to this notice. The complainant requested information about the cost to prisoners of making telephone calls from within a named prison, also the differences in the cost of calls charged to different categories of prisoner. The Commissioner’s decision is that the Ministry of Justice has now disclosed all of the information it holds that falls within the scope of the information request as section 1(1) FOIA (general right of access) requires so that she did not uphold the complaint. She further decided that, in delaying the issue of a response beyond the 20 working days statutory maximum time allowed, the Ministry of Justice had breached section 10(1) FOIA (time for compliance with request). The Commissioner does not require the public authority to take any further steps to comply with the legislation. Information Tribunal appeal EA/2017/0242 dismissed.

The complainant requested information put before the Solicitor General by Attorney General’s Office officials. The Solicitor General had decided that an application by the complainant for a fresh inquest into the death of his late mother would not have a reasonable prospect of success before the High Court. His request was refused relying on the section 42(1) FOIA exemption (legal professional privilege). The Commissioner decided that the section 42(1) FOIA exemption was engaged and was not persuaded that there was a compelling public interest in disclosure sufficient to override the inherent public interest in protecting legal professional privilege. She therefore decided that the Attorney General’s Office had correctly relied on the exemption to withhold the information. She also decided that the section 40(1) FOIA exemption (personal information) had been correctly applied to some of the information. The complainant submitted three requests to the Ministry of Defence (MOD) seeking information about the procurement of a particular contract. The MOD refused to answer requests on the basis that they were considered to be vexatious and further that given its previous correspondence with the complainant it was not under an obligation under section 17 of the FOIA to issue a formal refusal notice to the effect. The Commissioner has concluded that the requests are vexatious and therefore the MOD is not obliged, on the basis of section 14(1) of FOIA, to answer the requests. The Commissioner has also found that on basis of previous communications within the complainant the MOD was entitled to rely on the provisions contained at section 17(6) not to provide the complainant with a refusal notice stating that section 14(1) applied to his requests. Information Tribunal appeal EA/2017/0247 allowed.

The complainant requested information about court processes and procedures and highlighted a specific case as an example. The Ministry of Justice (the ‘MOJ’) refused to confirm or deny whether it held the requested information, citing section 32(3) court records and 40(5) personal information. Although following its internal review, the MOJ provided some of the requested information “in a general non-case specific basis”, it maintained that sections 32(3) and 40(5) applied. The Commissioner’s decision is that neither exemption is engaged because the request is not about a particular court case. She requires the MOJ to issue a fresh response under the FOIA to all parts of the request (apart from part 9) which does not rely on sections 40(5) or 32(3).

The complainant has requested a copy of a concession agreement between London Luton Airport Limited and the London Luton Airport Operating Company Limited.  Luton Borough Council initially withheld the information under the exemption for commercial interests – section 43(2) of the FOIA.  During the Commissioner’s investigation the public authority disclosed some information and withheld other information under the exception for commercial confidentiality – regulation 12(5)(e) of the EIR.  The Commissioner’s decision is that Luton Borough Council wrongly handled the request under the EIR and breached regulation 5(1) and regulation 14(1) of the EIR and that it correctly applied regulation 12(5)(e) to withhold some of the requested information.  The Commissioner does not require the public authority to take any steps.

Tate disclosed some information but refused to disclose other information citing sections 42 and 43 of the FOIA. The Commissioner’s decision is that the request should have been considered under the EIR. Tate stated that if the Commissioner decided the request is EIR, it wished to rely on regulations 12(5)(b) and 12(5)(e). The Commissioner has considered these exceptions. She has decided that regulation 12(5)(b) of the EIR does apply to the remaining withheld information under this exception. However, the Commissioner has decided that regulation 12(5)(e) of the EIR does not apply in this case. She therefore requires Tate to disclose all remaining withheld information, withheld under regulation 12(5)(e) of the EIR.
