The complainant has requested information relating to the Rural Payments Agency’s (RPA) collation and processing of land data and in particular relating to land parcels on a particular estate. Initially the RPA stated that the information is not held. It then changed its position at the internal review stage and said that the information is held but exempt from disclosure under regulations 12(4)(e), 12(5)(e) and 13 of the EIR. During the Commissioner’s investigation the RPA’s position changed again. It was however then later established that the RPA does hold recorded information falling within the scope of the request and that it considered this information was exempt from disclosure under regulations 12(4)(e) and 12(5)(e) of the EIR. The Commissioner’s decision is that although regulation 12(4)(e)of the EIR applies, the public interest in favouring of maintaining this exception is outweighed by the public interest in disclosure. The complainant submitted a request to Doncaster Council (the Council) seeking a copy of a particular letter sent by Sajid Javid, the then Communities Secretary, and also seeking copies of emails sent or received by the Council’s Chief Executive and Mayor concerning the subject of devolution in Yorkshire. The Council disclosed the copy of the letter sent by Mr Javid. However, it sought to withhold the remaining information falling within scope of the request on the basis of section 36(2)(b)(ii) (effective conduct of public affairs) of FOIA. During the course of the Commissioner’s investigation the Council disclosed all of the information it was seeking to withhold on the basis of this exemption with the exception of one email chain. The Commissioner has concluded that this email chain is exempt from disclosure on the basis of section 36(2)(b)(ii) of FOIA and that in all the circumstances of the case the public interest favours maintaining this exemption.

Barking, Havering and Redbridge University Hospitals NHS Trust (the Trust) provided some of the requested information, but has explained that it does not hold other information falling within the scope of the requests. The Trust has also refused to provide some of the requested information under sections 12(1) and 14(1) of the FOIA.
