Requirement 1

1. By 26 June 2026, the service provider must ensure that staff levels are right for people and to provide care to the expected and agreed standard to support their health and wellbeing. To do this, the service provider must, at a minimum: a) ensure that people's care and support needs are suitably assessed and sufficient staff members are provided for a person's support visit b) when a staff member is not available for a person's visit, this is quickly identified and responded to and the on-call arrangement or assessed contingency plan is able to address any concerns in a timely manner and c) any support visits that have had no or an insufficient number of staff members attending are monitored and steps to minimise any likelihood of this happening again are taken. This is to comply with Regulation 4(1)(a) of The Social Care and Social Work Improvement Scotland (Requirements for Care Services) Regulations 201. By 26 June 2026, to support a person's health and wellbeing, the service provider must ensure people, or their representatives, have regular and suitable opportunities to discuss their care and support needs and wishes. To do this, the service provider must, at a minimum, undertake a review at at least once in every six month period whilst the person receives the service. This is to comply with Regulation 5(2) of The Social Care and Social Work Improvement Scotland (Requirements for Care Services) Regulations 2011 (SSI 2011/210). This is to ensure that care and support is consistent with the Health and Social Care Standards (HSCS) which state that: 'My care and support meets my needs and is right for me' (HSCS 1.19) and 'I am fully involved in developing and reviewing my personal plan, which is always available to me.

Recommendation 1

1. To support people to be safe and have good outcomes, the service provider should make sure events of concern for people are, when necessary, reported to the Care Inspectorate. This is to ensure that care and support is consistent with the Health and Social Care Standards (HSCS) which state: 'I benefit from different organisations working together and sharing information about me promptly where appropriate, and I understand how my privacy and confidentiality are respected.' (HSCS 4.18)

Recommendation 2

2. To support good experiences, health and outcomes for people, the service provider should make sure staff and management communicate in a timely and effective manner with people using the service, other relevant people and with each other. This is to ensure that care and support is consistent with the Health and Social Care Standards (HSCS) which state: 'My care and support is provided in a planned and safe way, including if there is an emergency or unexpected event' (HSCS 4.14) and 'I use a service and organisation that are well led and managed.' (HSCS 4.23).

Recommendation 3

1. To support good experiences, health and outcomes for people, the service provider should make sure staff have opportunities to develop and learn as social care workers. This should include, but is not limited to, making sure staff training is up to date, and supervisions take place on a suitable regular basis. This is to ensure that care and support is consistent with the Health and Social Care Standards (HSCS) which state: ‘I have confidence in people because they are trained, competent and skilled’ (HSCS 3.14).

Recommendation 4

2. To support good experiences, health and outcomes for people, the service provider should make sure staff are all suitably registered with their professional body. This should include, but is not limited to, putting in place robust measures for monitoring staff's SSSC registration. This is to ensure that care and support is consistent with the Health and Social Care Standards (HSCS) which state: 'I use a service and organisation that are well led and managed.' (HSCS 4.23).

Recommendation 5

1. So as people are people experiencing high quality, safe care that meets their needs, rights and choices, the service provider should make sure quality assurance and care information gathering processes are up to date. This will help to inform and make sure the service improvement plan is focused on key areas and provides most benefit to people's care, support and outcomes. This is to ensure that care and support is consistent with the Health and Social Care Standards (HSCS) which state that: 'I experience high quality care and support based on relevant evidence, guidance and best practice' (HSCS 4.11); and 'I benefit from a culture of continuous improvement, with the organisation having robust and transparent quality assurance processes.' (HSCS 4.19).
