1. Under The Health and Care Staffing (Scotland) Act 2019 one of the principles is ensuring the wellbeing of staff. The service should ensure staff and others should not be at risk of passive smoking. To do this, the service should ensure they review everyone’s smoking agreements so that people who live in the service understand and comply with the rules of their tenancy agreement. This includes smoking being prohibited in bedrooms, and they must use the designated smoking area located in the garden. This is to ensure care and support is consistent with the Health and Social Care Standards (HSCS) which states: 'I am helped to understand the impact and consequences of risky and unsafe behaviour and decisions' (HSCS, 2.25) and 'I have enough physical space to meet my needs and wishes' (HSCS 5.22).

1. The service should ensure there is a designated smoking area to accommodate smokers, while still protecting the health and wellbeing of non smokers. They must ensure people can access the area independently or with support, and the appropriate shelter meets fire safety regulations. This is to ensure care and support is consistent with the Health and Social Care Standards (HSCS) which states: 'I can independently access the parts of the premises I use and the environment has been designed to promote this' (HSCS 5.11) and 'I experience an environment that is well looked after with clean, tidy and well maintained premises, furnishings and equipment' (HSCS 5.24).
