Given concerns from Universities UK that a special regime could lead the ONS to reclassify higher education providers as public sector bodies, as has happened with FE colleges, the Government should ask the ONS to lay out clear criteria for when such a reclassification would take place which can be kept in mind when designing the special regime. (Recommendation, Paragraph 147)
