Recommendation 42

42 Paragraph: 207

We applaud the progress made by the Solicitors Regulation Authority (SRA) in recent years.

Conclusion
We applaud the progress made by the Solicitors Regulation Authority (SRA) in recent years. However, we do not agree that it should conduct thematic evaluations of SLAPPs that deliberately exclude the law firms accused of malpractice. Predictably and implausibly, these evaluations have found limited evidence of wrongdoing. This risks creating a flawed evidence base to inform public debate. With transparent governance structures and information firewalls between teams, it should be possible to conduct multiple separate engagements with the same firm without prejudicing the outcome of investigations.
