Recommendation
It is unrealistic to expect the market to immediately provide a private sector mitigation solution for new regulatory schemes, especially where there is political uncertainty about their longevity. When new types of mitigation are required owing to advice from statutory consultees, the Government should work with Natural England to provide public sector mitigation schemes in the immediate term. These can be closed to new applicants or become a provider of last resort when a private sector market has developed.
