Recommendation 14

14 Paragraph: 111

Suspending an asylum claim for 6 months when there is no real prospect of it...

Conclusion
Suspending an asylum claim for 6 months when there is no real prospect of it being considered by another state amounts to an unjustified delay. It does not appear to 72 Legislative Scrutiny: Nationality and Borders Bill (Parts 1, 2 and 4) – Asylum, Home Office Decision-Making, Age Assessments, and Deprivation of Citizenship Orders be consistent with complying with the Refugee Convention ‘in good faith’. It also places the mental and physical health of vulnerable asylum seekers at risk, potentially resulting in violations of Article 8 or even Article 3 ECHR.
