Conclusion
A revision of section 19 HRA to place the requirement to provide Parliament with an ECHR memorandum on a statutory footing could help to improve the timely provision of these explanations. Such a Memorandum should be provided upon introduction of a Bill, showing the Government’s analysis of the human rights compatibility of the provisions of the Bill. It would also help to have clearer indications within this analysis as to whether the Government is proposing that the UK benefit from a wide margin of appreciation.
