Recommendation
Given the intention that these measures should be used in “cases that cannot be prosecuted or otherwise disrupted”, a requirement that the Secretary of State confirms with the police that prosecution is not realistic or feasible before a PIM is imposed would appear to be consistent with the policy justification. We recommend that the Bill is amended to include such a provision.
