Conclusion
The package of prohibitions and restrictions on access to the courts may risk breaching the right of access given the wide-ranging and absolute nature of many of the restrictions. In addition, Article 13 ECHR provides for the right to an effective remedy. Where access to the courts is shut down and the only avenue for recourse is a case review (with no remedy available), the Bill as drafted also risks non-compliance with Article 13.
