Conclusion
Clause 8 is an attempt to restrain the courts from finding that deportation legislation is incompatible with Article 8. The scope is narrow, as it does not apply to challenges to individual deportation decisions. It is designed to make it difficult for the courts to find that deportation legislation is incompatible with Article 8 in all but the rarest of cases. This clause may signal the Government’s intention to amend the deportation regime in a way which is highly restrictive of Article 8 rights.
