Conclusion
Clause 4(2) excludes from the “great weight” provision some of the most important scenarios in which the State may wish to restrict free speech: criminal proceedings and compatibility of criminal offences, certain immigration decisions, and decisions concerning national security. These are areas in which decisions taken by the State are likely to interfere with the right to free speech. The strengthened right to free speech will therefore only apply selectively.
