Conclusion
Without the usual safeguards of appeals and full judicial review, and without judicial reviews being suspensive in terms of removal, this legislation seriously risks children being treated incorrectly as adults as well as them being removed from the UK to unsuitable conditions. This is clearly not in the best interests of any child and is likely to breach the child’s rights under Articles 6, 8, and 13 of the ECHR. Clause 55 should be removed from the Bill (see Annex, Amendment 20).
