Conclusion
Further, if clause 2 remains in the Bill, the definition of “coming directly” in clause 2(5) must be amended to reflect the position in law and not the Government’s Legislative Scrutiny: Illegal Migration Bill 121 misconstruction of Article 31 (see Annex, amendment 3). The Nationality and Borders Act 2022 will also require amendment to reflect the proper interpretation of Article 31.
