Measures designed to tackle anti-social behaviour affect the rights of victims and those accused of anti-social behaviour. To ensure these rights are properly protected it is important that the impact and efficacy of these measures are properly understood. We agree that the Government should have carried out a review of the wide range of existing measures available to tackle ASB before introducing the respect order on top. (Conclusion, Paragraph 55)

The Government acknowledges the importance of ensuring that measures designed to tackle ASB protect the rights of all involved. The Respect Order was developed based on input from a range of front-line delivery partners and has been welcomed by the National Police Chiefs’ Council (NPCC) and ASB sector organisations. It was also developed in line with research undertaken by the Home Office on police perceptions of the powers in the 2014 Act1 in 2023 as well as the Civil Justice Council report on Anti-Social Behaviour and the Civil Courts in 2020.2 The other ASB measures in the Crime and Policing Bill, such as extending dispersal directions to 72 hours and increasing the upper limit for fixed penalty notices, were the subject of a public consultation in 2023 and received majority support, including from key ASB sector organisations, local authorities and policing.3 The new ASB data reporting powers provided for in clause 7 of the Bill, as well as new police data reporting requirements, will significantly improve the national picture of the use of these powers, ensuring a more comprehensive overview of their use and impact.
