Select committee: Constitution Committee

Conclusion 28

11th Report - Nationality and Borders Bill Published 21 Jan 2022 Paragraph 103
Conclusion (the committee's words)
It is not clear that consequential amendments to devolved legislation made under clause 80 would not be in areas of devolved competence. The Sewel convention does not apply to delegated legislation but it would be constitutionally questionable for Parliament to circumvent that convention by legislating in a way that foresees or intends delegated legislation to change devolved legislation in areas of devolved competence. The perception may arise, whether justified or not, that regulation-making powers under clause 80 may be used to avoid the Sewel convention.
