Recommendation 35

We are concerned by the potential complexity of the framework for the reallocation of cases in clause 3 of the bill. Some of the complexity appears to stem from the bill’s approach to allocation. If the Crown Court has more discretion to decide when a case should be allocated to a jury trial, that might reduce the instances where the reallocation process would be required.
