Conclusion
The evidence received suggests that a system of judge only trials is likely to be fairer and more efficient if defendants can elect for judge only trials. Although this would be in tension with the government’s view that only the courts should decide on allocation, there is merit to considering whether any alternative allocation mechanisms used in other jurisdictions would be fairer and more efficient.
