The Justice Committee finds that the Government has engaged well with the Crown Dependencies over Brexit, but more clarity is needed. The Government has said the Crown Dependencies formal relationship with the EU will end when the UK ceases to be a member. However, this does not affect the longstanding constitutional relationship between the Crown Dependencies and the UK. The UK Government has no plans to propose any changes to the constitutional relationship

The Government, in its letter to the Committee, says it has "no plans to propose any changes to the constitutional relationship" with the Crown Dependencies and is committed to taking their interests into account as the UK leaves the EU.

  • The Lord Chancellor "acknowledge[s]" the Committee's question on how the UK might manage a situation where UK and Crown Dependency interests "fundamentally differ", and says the Ministry of Justice is responsible for ensuring those interests are "understood and taken into account across Whitehall".
  • It reports that official-level roundtables are being held on financial services, trade, agriculture and fishing, the Common Travel Area and customs, and that the Parliamentary Under Secretary of State for Exiting the European Union has chaired regular meetings with the Chief Ministers and "will continue to do so".
  • The Government says it "will continue to honour" the 2007 to 2008 International Identity Framework Agreements, under which the UK will not act internationally for a Crown Dependency without prior consultation.
