Implications of Brexit for the justice system inquiry

The Government's response sets out an aim for a "deep and special partnership" with the EU on justice matters, and states intentions on the Rome Regulations and the Hague and Lugano Conventions.

• On family and civil matters, the Government is "seeking an agreement with the EU" for close cooperation "reflecting closely the substantive principles of the current framework", including mutual recognition and enforcement of judgments.
• It states its intention to incorporate the Rome I and II rules into domestic law as it legislates for withdrawal, and to "continue to participate" in the Hague Conventions. It "will seek to continue to participate" in the Lugano Convention.
• On the CJEU, the Government says its direct jurisdiction in the UK will end, and points to precedents such as joint committees and reporting and monitoring requirements for resolving disputes.
• On transition, it proposes "an implementation period of around two years" on current terms, which "should be agreed as early as possible". It says the Government is "considering all options" for mitigating risks to existing cross-border financial services contracts.
