Select committee: Delegated Powers and Regulatory Reform Committee

Conclusion 14

12th Report - Democracy Denied? The urgent need to rebalance power between Parliament and the Executive Published 24 Nov 2021 Paragraph 97
Conclusion (the committee's words)
When drafting a delegated powers memorandum for a bill which includes a power to issue guidance, departments must clearly explain and justify the character of the guidance. Where guidance is, in effect, legislative in character, it should be laid before Parliament and subject to parliamentary scrutiny.
