Unclear application of mitigation requirements to other Windrush claim categories persists.
Conclusion
While the Home Office has said that awards for loss of access to employment are no longer capped because of a lack of mitigation action, we have been unable to clarify how the mitigation requirements are being applied to other claim categories, as appears to be allowed within the scheme rules. For each claim category, the Home Office should provide us with data for the number of times a decision to reduce or decline an award has been referred for approval because of the mitigation requirements and the number of times an award has been reduced or declined on this basis subsequently.
