We urge the Government to include as much detail in the Bill itself or to publish the secondary legislation alongside it. It is especially important that this be done for core provisions such as the Gateways process and the regulation of construction products.

12. We agree with the Committee that it is important the Government’s intentions for how key elements of the new regulatory regime will operate are made clear during passage of the Building Safety Bill. 13. The use of delegated powers is essential for Government to respond quickly to an evolving evidence base on building safety and any emerging risks. Through secondary legislation, the Secretary of State will be able to make regulations that support the Building Safety Regulator in shaping and flexing the assurance regime based on evidence of risk; while providing clarity to the sector on its responsibilities and duties. 14. It is the Government’s intention to publish further detail on key elements of the new regime, including the Gateways process and construction products before the relevant clauses are considered in committee. We want to work with residents, industry, and Parliament to ensure these regulations are fit for purpose. In publishing these during passage of the Bill, we aim to give Parliament sufficient opportunity to scrutinise and comment on our proposals.
