We are concerned that the Government’s Build Back Better High Streets strategy does not mention Company Voluntary Arrangements. The Government continues to believe that Company Voluntary Arrangements are a valuable tool within the Insolvency framework for rescuing businesses across the whole economy. However, recognising the concerns being raised by commercial landlords, the Insolvency Service has recently tendered for research into whether commercial landlords in certain sectors of the economy are unfairly treated in comparison to other creditors in Company Voluntary Arrangements, and how they interact with commercial leases. The findings of this research will inform whether any further review or changes to the framework are necessary.
